ARTICLE 1 – DEFINITIONS / ARTIKEL 1 – DEFINITIES

Entrepreneur: The natural or legal person offering products and/or services remotely to consumers.
Ondernemer: De natuurlijke of rechtspersoon die producten en/of diensten op afstand aanbiedt aan consumenten.

Consumer: The natural person who is not acting in the exercise of a profession or business.
Consument: De natuurlijke persoon die niet handelt in de uitoefening van beroep of bedrijf.

Distance Agreement: An agreement concluded through the webshop or other digital communication methods.
Overeenkomst op afstand: Een overeenkomst die wordt gesloten via de webshop of andere digitale communicatiemiddelen.

Cooling-off Period: The period during which the consumer may exercise the right of withdrawal.
Bedenktijd: De termijn waarbinnen de consument gebruik kan maken van het herroepingsrecht.

Right of Withdrawal: The consumer's right to cancel the purchase within the cooling-off period.
Herroepingsrecht: De mogelijkheid van de consument om binnen de bedenktijd af te zien van de aankoop.

Products: All items offered through the webshop, including shoes, accessories, and related products.
Producten: Alle artikelen aangeboden via de webshop, waaronder schoenen, accessoires en aanverwante artikelen.

ARTICLE 3 – APPLICABILITY / ARTIKEL 3 – TOEPASSELIJKHEID

These Terms & Conditions apply to all offers, orders, and agreements made through the Belucci Milano webshop.

Deze algemene voorwaarden zijn van toepassing op alle aanbiedingen, bestellingen en overeenkomsten via de webshop van Belucci Milano.

By placing an order, the consumer agrees to these Terms & Conditions.

Door een bestelling te plaatsen gaat de consument akkoord met deze voorwaarden.

Any deviations from these Terms & Conditions are only valid if agreed upon in writing.

Afwijkingen van deze voorwaarden zijn alleen geldig indien schriftelijk overeengekomen.

Belucci Milano streeft ernaar productinformatie, afbeeldingen en prijzen zo correct mogelijk weer te geven.

Obvious errors or mistakes in the offer are not binding.

Kennelijke fouten of vergissingen in het aanbod binden Belucci Milano niet.

Offers are valid while supplies last.

Aanbiedingen gelden zolang de voorraad strekt.

ARTICLE 5 – THE AGREEMENT / ARTIKEL 5 – DE OVEREENKOMST

The agreement is concluded once the consumer places an order and receives confirmation.

De overeenkomst komt tot stand zodra de consument een bestelling plaatst en hiervan een bevestiging ontvangt.

Belucci Milano reserves the right to refuse orders in cases of suspected fraud, misuse, or incorrect information.

Belucci Milano behoudt zich het recht voor bestellingen te weigeren bij vermoeden van misbruik, fraude of onjuiste gegevens.

ARTICLE 6 – PRICES AND PAYMENTS / ARTIKEL 6 – PRIJZEN EN BETALINGEN

All prices are stated in euros and include VAT unless otherwise specified.

Alle prijzen zijn vermeld in euro’s en inclusief btw, tenzij anders aangegeven.

Any shipping costs will be clearly displayed during checkout.

Eventuele verzendkosten worden duidelijk vermeld tijdens het bestelproces.

Payment must be made using the available payment methods.

Betaling dient te gebeuren via de aangeboden betaalmethoden.

Belucci Milano reserves the right to change prices at any time.

Belucci Milano behoudt zich het recht voor prijzen op ieder moment te wijzigen.

ARTICLE 7 – DELIVERY AND SHIPPING / ARTIKEL 7 – LEVERING EN VERZENDING

Orders are processed and shipped within the indicated delivery timeframe.

Bestellingen worden verwerkt en verzonden binnen de aangegeven levertijd.

Delays do not entitle the consumer to compensation.

Vertragingen geven geen recht op schadevergoeding.

Belucci Milano is not liable for delays caused by carriers or customs procedures.

Belucci Milano is niet aansprakelijk voor vertragingen veroorzaakt door vervoerders of douaneprocedures.

The risk of damage or loss transfers to the consumer once the package has been delivered.

Het risico van beschadiging of vermissing gaat over op de consument zodra het pakket is geleverd.

ARTICLE 8 – RIGHT OF WITHDRAWAL AND RETURNS / ARTIKEL 8 – HERROEPINGSRECHT EN RETOUREN

The consumer has the right to cancel the order within 14 days of receipt without providing a reason.

De consument heeft het recht de bestelling binnen 14 dagen na ontvangst zonder opgave van reden te annuleren.

Return requests must be submitted within this period.

Retouraanvragen dienen binnen deze termijn schriftelijk te worden gemeld.

Products must be returned unused, clean, and preferably in their original packaging.

Producten dienen ongebruikt, schoon en indien mogelijk in originele verpakking geretourneerd te worden.

Return shipping costs are the responsibility of the consumer unless otherwise agreed.

Retourkosten zijn voor rekening van de consument, tenzij anders overeengekomen.

ARTICLE 9 – EXCLUSION OF THE RIGHT OF WITHDRAWAL / ARTIKEL 9 – UITSLUITING VAN HET HERROEPINGSRECHT

The right of withdrawal does not apply to:

• Customized or personalized products / Maatwerk of gepersonaliseerde producten
• Products that cannot be returned for hygiene reasons after use / Producten die om hygiënische redenen niet kunnen worden geretourneerd na gebruik
• Products showing signs of wear or damage caused by the customer / Producten die tekenen van gebruik of schade door de klant vertonen
• Products that deteriorate quickly or have a limited shelf life / Producten die snel bederven of een beperkte houdbaarheid hebben

ARTICLE 10 – WARRANTY AND LIABILITY / ARTIKEL 10 – GARANTIE EN AANSPRAKELIJKHEID

Belucci Milano guarantees that products conform to the agreement and meet reasonable quality standards.

Belucci Milano staat ervoor in dat de producten voldoen aan de overeenkomst en redelijke eisen van kwaliteit.

Belucci Milano is not liable for damage resulting from improper use of products.

Belucci Milano is niet aansprakelijk voor schade ontstaan door verkeerd gebruik van producten.

ARTICLE 11 – COMPLAINTS PROCEDURE / ARTIKEL 11 – KLACHTENREGELING

Complaints must be submitted in writing within a reasonable period after discovery.

Klachten dienen binnen een redelijke termijn na ontdekking schriftelijk te worden gemeld.

Belucci Milano will respond within 14 days.

Belucci Milano reageert binnen 14 dagen op klachten.

If a complaint cannot be resolved amicably, Dutch law shall apply.

Indien een klacht niet in onderling overleg kan worden opgelost, ontstaat een geschil waarop Nederlands recht van toepassing is.

ARTICLE 12 – PRIVACY / ARTIKEL 12 – PRIVACY

Personal data is processed in accordance with applicable privacy legislation and the Belucci Milano Privacy Policy.

Persoonsgegevens worden verwerkt conform de geldende privacywetgeving en het privacybeleid van Belucci Milano.

ARTICLE 13 – APPLICABLE LAW / ARTIKEL 13 – TOEPASSELIJK RECHT

All agreements and disputes are exclusively governed by Dutch law.

Op alle overeenkomsten en geschillen is uitsluitend Nederlands recht van toepassing.
